TREASURERÕS REQUESTS/RECOMMENDATIONS - Not included in Consent Agenda: Approval to Proceed with Submission to Electors Renewal of Existing Tax Levy Ð Resolution #2021-117 Mr. Warren moved and Mr. Polis seconded with all members present voting aye to approve a resolution determining to proceed with the submission to the electors of Poland Local School District the question of the renewal of an existing tax levy, pursuant to sections 5705.194 through 5705.197 of the revised code. Motion passed 5-0. WHEREAS, on May 24, 2021, this Board adopted a resolution declaring it necessary to submit to the electors of the District the question of the renewal of an existing tax levy in excess of the tenmill limitation, as described below, a copy of which resolution was certified to the Mahoning County Auditor; and WHEREAS, that County Auditor subsequently certified to this Board that the total current tax (assessed) valuation of the District is $447,525,660 and that the estimated annual tax levy required throughout the life of the proposed levy to produce the annual amount of $2,181,867 as set forth in that resolution, calculated in the manner provided by Section 5705.195 of the Revised Code, is 4.9 mills for each one dollar of valuation, which amounts to 49 cents for each one hundred dollars of valuation; NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Poland Local School District, County of Mahoning, State of Ohio, that: Section 1. This Board hereby determines to proceed with the submission to the electors at an election to be held on November 2, 2021, of the question of the renewal of all of an existing tax levy in excess of the tenmill limitation (commencing with a levy on the tax list and duplicate for the year 2022 to be first distributed to the Board in calendar year 2023) in order to raise the amount of $2,181,867 each year for five years for the purpose of providing for the emergency requirements of this District, at the annual tax rate as is necessary to raise that amount, which rate is currently estimated by the Mahoning County Auditor to be 4.9 mills for each one dollar of valuation, which amounts to 49 cents for each one hundred dollars of valuation. Section 2. The Treasurer is authorized and directed to certify to the Mahoning County Board of Elections copies of this resolution and the resolution of this Board and certificate of the County Auditor referred to in the preambles hereto, before the close of business on August 4, 2021. This Board hereby requests that the Board of Elections give notice, prepare the ballots, and make other necessary arrangements for the submission of this question to the electors of this District, all in accordance with law. Section 3. It is hereby found and determined that all formal actions of this Board and of any of its committees concerning and relating to the adoption of this resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and of any of its committees that resulted in those formal actions were in meetings open to the public, in compliance with the law. Section 4. This resolution shall be in full force and effect from and immediately upon its adoption. Approval to Submit to Electors Renewal of Existing Permanent Improvement Tax Levy Ð Resolution #2021-118 Ms. Colucci moved and Mr. Polis seconded with all members present voting aye to approve a resolution pursuant to Section 5705.21 of the revised code submitting to the electors of the Poland Local School District the question of the renewal of an existing Tax Levy for the purpose of permanent improvements. Motion passed 5-0. WHEREAS, at an election held on May 2, 2017, the electors of this School District approved the renewal of a 1.0-mill levy, for the purpose of permanent improvements, for five years; and WHEREAS, the authority to levy that 1.0-mill tax expires with the levy on the 2021 tax list and duplicate for last collection in calendar year 2022, and, in order to provide for the collection of tax revenues for that purpose without interruption, this Board finds it necessary to renew the existing 1.0-mill levy for five years; and WHEREAS, on May 24, 2021, this Board adopted Resolution No. 2021-84 pursuant to Section 5705.03(B) of the Revised Code, declaring it necessary to renew the existing 1.0-mill tax levy and requesting the Mahoning County Auditor to certify the total current tax valuation of the School District and the dollar amount of (annual) revenue that would be generated by that renewal levy; and WHEREAS, the County Auditor then certified that the total tax valuation of the School District is $447,525,660 and the estimated property tax revenue that will be produced by the 1.0-mill renewal tax levy is $388,752 annually during the life of the levy, assuming that the tax valuation remains constant throughout the life of the levy; NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Poland Local School District, County of Mahoning, Ohio, two-thirds of all members of that Board elected thereto concurring, that: Section 1. This Board hereby finds, determines and declares that the amount of taxes which may be raised by the Board of Education of the Poland Local School District within the ten-mill limitation by levies on the current tax list and duplicate will be insufficient to provide an adequate amount for the necessary requirements of this School District, and that it is necessary to renew the levy of a tax in excess of that limitation at the rate of 1.0 mills for five years for the purpose of permanent improvements. Section 2. The question of the renewal of an existing 1.0-mill tax levy for the purpose of permanent improvements, for five years, beginning with the tax list and duplicate for the year 2022, the proceeds of which levy first would be available to the School District in the calendar year 2023, shall be submitted under the provisions of Section 5705.21 of the Revised Code to the electors of the Poland Local School District at an election to be held therein on November 2, 2021, as authorized by law. That election shall be held at the regular places of voting in the School District as established by the appropriate board(s) of elections, or otherwise, within the times provided by law and shall be conducted, canvassed and certified in the manner provided by law. Section 3. The Treasurer of this Board is hereby authorized and directed to give or cause to be given notice of that election as provided by law. Section 4. The Treasurer is hereby directed to deliver a certified copy of this resolution, together with the resolution adopted on May 24, 2021, referred to in the third preamble to this resolution, and the related County AuditorÕs certificate, to the Mahoning County Board of Elections before the close of business on August 4, 2021. Section 5. This Board finds and determines that all formal actions of this Board and of any of its committees concerning and relating to the adoption of this resolution were taken, and all deliberations of this Board and of any of its committees that resulted in such formal action were held, in meetings open to the public, in compliance with the law.
